Agreed to his parents because they did not let his girlfriend spend the night at home
The head of the Criminal Court number 3 of Santander has sentenced a young man of 21 years of age who assaulted his parents with whom he argued because they did not allow his girlfriend to spend the night at the family home.
The sentence specifically condemns the aggressor, Julián RF, born in October of the year 1990, to eleven months in prison for a crime of domestic violence of physical abuse and prohibition of approaching his mother for a period of two years, which also must compensate with 90 euros, and the payment of a fine for the same amount as the author of a lack of injury, and prohibition to approach for six months to his father who must compensate with 120 euros.
The events that led to the conviction, in which the aggravating circumstance of recidivism was applied, occurred at 2.15 am on December 22, 2011, when the accused went to the family home, located in Santander, where he lived with his parents.
The young man, who had already been sentenced in 2010 for two crimes of domestic violence and gender, injuries and family mistreatment to the punishment, among others, of 8 months in prison, began a discussion with his parents as they did not consent that the girlfriend of that one stayed overnight in the house.
In the course of the discussion, the defendant struggled with his father, pushing him and throwing him against the dining table, and also pushed and kicked his mother in the chest, who suffered injuries that required medical assistance.
The ruling does not apply the mitigating circumstance derived from the consumption of alcoholic beverages, although both parents indicated that at the time of the events their son was somewhat drunk.
And this is because the defendant did not even invoke alcoholic consumption in the course of previous proceedings, and because, in any case, besides the mere fact of alcohol intake, a psychic effect or affect on the volitional and intellective faculties of the subject, which also does not appear concurred in this case, indicates the sentence
